Terms of Service for Froz™

You must meet the minimum age requirement for your country to use Froz. Minimum Age by Country: • United States: 13 years old • Canada: 14 years old • Other countries: 13 years old (or higher if required by local law) Age Verification: • During registration, you are required to provide your date of birth and country. • We verify that users meet the minimum age requirement for their selected country before account creation. • If you provide false age or country information, your account will be terminated. • If we discover you do not meet the age requirement for your country, your account will be immediately deleted. By using Froz, you represent and warrant that you meet the age eligibility requirements for your country and that all information you provide is accurate.

You are responsible for maintaining the security of your account. • Keep your password confidential and do not share it with others. • You are responsible for all activity that occurs under your account. • Notify us immediately at support@froz-app.com if you suspect unauthorized access. • We are not liable for losses caused by unauthorized use of your account. We reserve the right to disable accounts that we believe have been compromised.

You agree to use Froz responsibly and not engage in: • Unlawful, harmful, threatening, abusive, or harassing behavior. • Posting false, misleading, or deceptive content. • Impersonating others or misrepresenting your identity. • Spamming, phishing, or distributing malware. • Harassment, bullying, or discrimination against other users. • Attempting to hack, reverse-engineer, or exploit the app. • Circumventing security measures or access controls. • Scraping data or using automated tools without permission. You are responsible for all content you post, including its accuracy and compliance with applicable laws.

Froz provides messaging features to connect users. When using these features: • Do not send unsolicited, abusive, or harassing messages. • Do not share illegal content, explicit material, or spam. • Respect other users' boundaries and privacy. • Report inappropriate messages using the in-app reporting feature. We reserve the right to monitor messages for safety purposes and may take action against users who violate these guidelines.

Froz enables users to organize and join community meetups, including local and global/international meetups. IMPORTANT: • Meetups are organized by users, not by Froz. • You participate in meetups entirely at your own risk. • Froz is NOT responsible for the conduct of other users at meetups. • Froz is NOT liable for any injuries, accidents, theft, or damages occurring at meetups. • Always meet in public places and inform someone of your plans. • Verify the identity of people you meet through Froz. • Use your own judgment about safety and trust your instincts. • Report suspicious or dangerous behavior immediately. International/Global Meetups: When participating in meetups in other countries, you are solely responsible for compliance with local laws, visa requirements, travel safety, and any associated risks. Froz provides no travel advice, insurance, or assistance for international meetups. Meetup Chat Messages: Messages in meetup chats are retained while the meetup is active. When a meetup organizer deletes a meetup, associated messages are removed after a 30-day grace period. Reported messages may be retained longer for investigation. By using the meetup feature, you acknowledge these risks and agree that Froz bears no responsibility for in-person interactions.

Froz offers optional GPS-based ski/snowboard tracking. • Location tracking is disabled by default and requires your explicit consent. • You control when tracking is active. • Tracked data is used to record your skiing activity and generate statistics. • Be aware of your surroundings when using tracking features. • Froz is not responsible for accidents that occur while using tracking features. Always prioritize your safety over app usage while skiing or snowboarding.

Your privacy is important to us. • We do not sell, rent, or trade your personal data. • Data collection is limited to what's necessary for app functionality. • Your data is protected with industry-standard security measures. • You can request deletion of your account and data at any time. • We use analytics to improve the app experience. The Froz app, logo, brand, and related content are owned by Froz and protected by intellectual property laws. User Content: • You retain ownership of content you post (photos, comments, etc.). • By posting, you grant Froz a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the app. • You may delete your content at any time. • We may remove content that violates these Terms. You may not copy, modify, or distribute Froz's proprietary content without permission.

Froz uses proprietary technology that constitutes valuable trade secrets: GPS Tracking Algorithm: • Our ski/snowboard tracking system uses proprietary algorithms to calculate speed, elevation, distance, and run statistics. • The tracking methodology, calculations, and data processing techniques are trade secrets. • Tracking results are provided "as is" and may not be 100% accurate due to GPS limitations, terrain, weather, or device factors. • Froz is not liable for inaccuracies in tracking data. Resort Ranking Engine: • Our resort ranking system uses proprietary algorithms incorporating user ratings, activity data, and other factors. • The ranking methodology and weighting factors are trade secrets. • Rankings are for informational purposes only and do not constitute endorsements. Snow Quality Index (SQI™): • Our proprietary Snow Quality Index uses algorithms to calculate snow conditions based on weather data. • SQI scores, descriptions, and recommendations are generated algorithmically. • SQI is provided for informational purposes only and should not be relied upon for safety decisions. • Actual snow conditions may vary significantly from SQI predictions. Weather Forecasts, Titles & Recommendations: • Weather data is sourced from third-party providers (Open-Meteo API) and processed using our proprietary algorithms. • Custom weather titles and descriptions are generated by our proprietary rules-based algorithm working in parallel with SQI. • The weather title/description generation methodology is a trade secret. • "Best day" recommendations (indicated by colors/indicators) are algorithmic suggestions, not guarantees. • All generated content (titles, descriptions, recommendations) is provided for informational purposes only. • Froz is NOT responsible for weather forecast accuracy or decisions made based on weather information. • Always check official resort communications and local conditions before skiing. Prohibited Activities: • You may not reverse-engineer, decompile, or attempt to discover the source code or algorithms. • You may not scrape, copy, or extract ranking data, SQI calculations, or tracking algorithms. • You may not create derivative works based on our proprietary technology. • You may not use automated tools to interact with ranking, weather, or tracking systems. Violation of this section may result in immediate account termination and legal action.

We strive to maintain a safe and respectful community through both automated and manual content moderation. Automated Content Screening: • Profile photos are automatically screened for prohibited content (adult, explicit, violent, or inappropriate material) using automated image analysis technology. • Text content (posts, comments, messages) may be analyzed for policy violations. • Content that fails automated screening will be rejected and not uploaded. Rate Limiting & Restrictions: • Repeated attempts to upload prohibited content may result in temporary restrictions on your account. • After multiple failed upload attempts, you may be temporarily blocked from uploading new content. • These restrictions reset automatically after a cooling-off period. User Reporting: • Users can report inappropriate content or behavior using in-app tools. • We review reports and may remove content or suspend accounts at our discretion. • Repeated violations may result in permanent account termination. We are not obligated to monitor all content but reserve the right to do so. If you see content that violates these Terms, please report it immediately.

We may suspend or terminate your account if: • You violate these Terms of Service. • You provide false information during registration (including age). • You engage in harmful, abusive, or illegal behavior. • Your account poses a security risk. • We receive valid legal requests requiring account action. • We discontinue the service (with notice). You may delete your account at any time through Settings. Upon termination, your data will be handled according to our Privacy Policy.

Leaderboards are for entertainment and community engagement only. • Rankings are determined by app activity (check-ins, resorts visited, etc.). • Froz reserves the right to adjust ranking algorithms. • Froz is not liable for disputes over scores or rankings. • Attempting to manipulate rankings may result in account termination.

Froz features community-driven live reports where users share real-time conditions at resorts. Submitting Live Reports: • Live reports reflect your personal observations at the time of submission. • You are responsible for the accuracy and truthfulness of your reports. • Do not submit false, misleading, or malicious reports. • Reports may be upvoted or downvoted by the community. Upvoting & Downvoting: • The voting system helps surface helpful reports. • Vote manipulation (fake accounts, coordinated voting) is prohibited. • Froz may adjust or remove votes that appear fraudulent. Disclaimers: • Live reports are user-generated and NOT verified by Froz. • Conditions can change rapidly - reports may be outdated. • Never rely solely on live reports for safety decisions. • Froz is NOT liable for decisions made based on live reports. Content Removal: • Froz may remove reports that violate these Terms or appear fraudulent. • Repeated submission of false reports may result in account termination.

Froz allows users to rate and review ski resorts/mountains, post comments, and contribute to Mountain DNA tags. By submitting ratings, reviews, comments, or tags, you agree: User Responsibility: • Your ratings, reviews, and comments represent your personal opinions and experiences. • You are solely responsible for the content of your submissions. • You will not submit false, misleading, defamatory, or malicious content. • You will not submit reviews for resorts you have not visited. • You will not accept compensation from resorts or competitors to influence your ratings, comments, or tags. Resort Comments: • Each resort has a global comments section where users can share experiences and discuss the mountain. • Comments are public and visible to all users. • You are responsible for the content of your comments. • Do not post spam, harassment, illegal content, or personal attacks. • Froz may remove comments that violate these Terms or community guidelines. • Froz is NOT liable for opinions expressed in user comments. Mountain DNA (Community Tags): • Mountain DNA tags (e.g., terrain difficulty, moguls, powder, crowds) are community-driven and represent aggregated user opinions. • Tags are subjective descriptions based on user experiences and perceptions. • Froz does NOT verify or guarantee the accuracy of Mountain DNA tags. • Tag results may not reflect actual resort conditions - terrain difficulty is subjective. • NEVER rely on Mountain DNA tags for safety decisions or skill-level assessments. • Always ski/ride within your ability level regardless of how a mountain is tagged. • Froz is NOT liable for injuries or accidents resulting from reliance on Mountain DNA tags. Froz's Role: • Froz aggregates user ratings and tags using proprietary algorithms. • Froz does NOT endorse, verify, or guarantee the accuracy of user-submitted content. • Froz is NOT responsible for user opinions expressed in ratings, reviews, or tags. • Froz is a neutral platform and does not create rankings or tags editorially. Resort Rankings: • Overall resort rankings are calculated algorithmically based on user ratings and other objective factors. • Rankings are provided for informational and entertainment purposes only. • Froz makes no representations about resort quality, safety, or suitability. • Rankings may change as new ratings are submitted. Content Removal: • Froz reserves the right to remove ratings, reviews, or tags that violate these Terms, appear fraudulent, or are submitted as part of manipulation schemes. • Resorts may not demand removal of legitimate negative reviews or unfavorable tags. By submitting a rating, review, comment, or tag, you grant Froz a perpetual, royalty-free license to display and use your submission within the App.

Froz displays information about ski resorts and mountains collected from various sources. IMPORTANT DISCLAIMERS: Data Sources & Accuracy: • Resort information (elevation, trails, lifts, acres, amenities, etc.) is compiled from public sources, resort websites, and third-party databases. • We strive for accuracy but DO NOT guarantee the completeness, accuracy, or currentness of any resort information. • Data may be outdated, incorrect, or differ from actual resort conditions. • Resorts frequently change their statistics, amenities, operating hours, and features. What May Be Inaccurate: • Elevation data (summit, base, vertical drop) may vary based on measurement methods • Trail and lift counts may change seasonally or permanently • Skiable acreage figures are approximate • Amenities (night skiing, terrain parks, etc.) may not reflect current availability • Pass affiliations (Ikon, Epic, etc.) may change • Contact information, websites, and addresses may be outdated • Nearest airport/city distances are approximate Your Responsibility: • ALWAYS verify resort information directly with the resort before making travel plans. • Do not rely solely on Froz data for trip planning, safety decisions, or purchases. • Check official resort websites and communications for current conditions. Limitation of Liability: • Froz is NOT liable for any losses, damages, or inconveniences resulting from inaccurate resort information. • Froz is NOT responsible for decisions made based on displayed resort data. • If you discover inaccurate information, please report it to support@froz-app.com. Resorts and data providers may contact us to request corrections or updates.

Froz features curated lists and recommendations for gear, après, events, resorts, and other skiing/snowboarding-related content. Editorial & Curated Content: • Featured lists may be curated editorially by Froz or through paid sponsorships. • Inclusion of any brand, product, business, resort, event, or service in a featured list does NOT imply: - Endorsement by the featured entity of Froz - Partnership or affiliation between Froz and the featured entity - Any warranty or guarantee of quality by Froz • Brands, products, and businesses may be featured without their solicitation or approval. • Featured content represents Froz's editorial selections or paid placements, not endorsements from featured entities. Sponsored Content & Advertising: • Featured lists may include both editorial selections and paid partner placements. • Paid or sponsored items are indicated with a "Partner" label or similar designation. • Items without a partner label are editorial selections curated by Froz. • Froz may receive compensation for featuring certain products, services, or businesses. • The presence of sponsored content does not affect our editorial independence for non-sponsored selections. Third-Party Products & Services: • Froz does NOT sell products or services directly. • We are not responsible for the quality, safety, availability, or accuracy of third-party products or services. • Your purchase or use of featured products/services is at your own risk. • Any transactions are between you and the third-party provider. • Froz is not liable for any issues arising from third-party products or services. Location-Based Featured Content: • With your permission, we may show featured content relevant to your location. • Local recommendations are based on geographic proximity, not guaranteed availability. • Featured local businesses may change hours, close, or relocate without notice. Trademarks & Brand Names: • All product names, logos, and brands mentioned are property of their respective owners. • Use of these names is for identification purposes only and does not imply endorsement. • Froz respects intellectual property rights and uses brand names under nominative fair use principles. For Businesses & Brands: • If you represent a business or brand and wish to be featured, removed, or have information corrected, contact support@froz-app.com. • Businesses may not demand removal from editorially-curated lists for non-defamatory content.

FROZ IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. • We do not guarantee uninterrupted or error-free service. • We make no warranties regarding accuracy, reliability, or availability. • We are not responsible for injuries, accidents, or damages during skiing, snowboarding, or related activities. • We are not responsible for the actions of other users. • App features and content may change without notice. YOU USE FROZ AT YOUR OWN RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW: • Froz and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages. • We are not liable for loss of data, profits, or goodwill. • We are not liable for any injuries or damages from skiing/snowboarding activities. • We are not liable for actions of other users, including at meetups. • Our total liability shall not exceed the amount you paid (if any) to use Froz in the past 12 months, or $100, whichever is less.

You agree to indemnify, defend, and hold harmless Froz, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: • Your use of the app. • Your violation of these Terms. • Your violation of any third-party rights. • Content you post or share. • Your participation in meetups or interactions with other users.

PLEASE READ THIS SECTION CAREFULLY. For United States Users: You agree that any dispute arising from these Terms or your use of Froz will be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court. • Arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association. • Arbitration will take place in California, USA, or remotely. • Each party bears their own costs, with arbitration fees split equally. • The arbitrator's decision is final and binding. CLASS ACTION WAIVER (U.S. Users): You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration. You may opt out of arbitration by emailing support@froz-app.com within 30 days of creating your account. For Canadian Users: This arbitration clause applies to the extent permitted by applicable Canadian law. Provincial consumer protection legislation may provide you with additional rights that cannot be waived. • In provinces where consumer protection laws prohibit mandatory arbitration (such as Quebec), you retain the right to bring claims in court. • Class action waivers may not be enforceable in certain Canadian provinces. • Nothing in these Terms limits your rights under applicable Canadian consumer protection legislation. • You may have the right to commence proceedings in your province of residence.

We may update these Terms at any time. • Material changes will be communicated via the app or email. • The "Last Updated" date will reflect changes. • Continued use after changes means you accept the updated Terms. • If you disagree with changes, you should stop using Froz and delete your account.

For United States Users: These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. For matters not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California. For Canadian Users: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, except where superseded by mandatory provincial consumer protection laws. If you reside in Quebec, the laws of Quebec apply to the extent required by Quebec consumer protection legislation. • You may bring proceedings in the courts of your province of residence. • Nothing in these Terms excludes or limits your rights under applicable Canadian consumer protection legislation. • Mandatory consumer protection laws of your province of residence will apply to the extent they provide greater protection than these Terms.

This section applies to users accessing Froz from Canada. Minimum Age: Users in Canada must be at least 14 years old to use Froz, in compliance with Quebec's Law 25 requirements. This applies to all Canadian provinces and territories. Consumer Protection: These Terms are subject to applicable Canadian federal and provincial consumer protection legislation. Nothing in these Terms is intended to exclude, restrict, or modify rights you may have under consumer protection laws that cannot be excluded, restricted, or modified by agreement. Language: You have expressly requested that these Terms and all related documents be drawn up in English. Privacy: Your personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy legislation including PIPEDA and, where applicable, provincial privacy laws. Electronic Communications: By using Froz, you consent to receiving electronic communications from us. This consent is provided in accordance with Canada's Anti-Spam Legislation (CASL). You may withdraw consent at any time. Quebec Users: If you reside in Quebec, certain provisions of these Terms may be superseded by the Consumer Protection Act (Quebec) and other applicable Quebec legislation. You retain all rights that cannot be waived under Quebec law. Complaints: Canadian users may file complaints regarding privacy matters with the Office of the Privacy Commissioner of Canada (www.priv.gc.ca) or with their provincial privacy commissioner.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable. If any provision is unenforceable under the laws of a particular jurisdiction, it will be unenforceable only in that jurisdiction and will not affect the enforceability of remaining provisions or in other jurisdictions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Froz regarding your use of the App. These Terms supersede any prior agreements or understandings. Any failure by Froz to enforce a right or provision does not waive that right.
